Glad you've picked up on that as I'd been wondering if Embraer had changed their policy. Unlike Airbus and Boeing, Embraer weren't fitting ADS-B at point of manufacture unless necessary. It seems that is still the case. Perhaps it's a question of cost. I guess it will change as ADS-B becomes mandatory throughout the rest of the world (it is here in Australia from December last year for aircraft flying at or above FL290). The E190's here with Virgin had to be retro-fitted prior to the date it became mandatory, as did many older aircraft (or they got flogged off).

About 40% of E190 comes with ADSB and 60% without, it's up to airline to decide.

KLM Cityhopper adds E190s to its fleet

Did some digging and it helps to explain the case with the Embraer 190 mentioned above. They are leased through BOC Aviation to replace the Fokker 70's which adds another dimension to the ADS-B/non ADS-B equation. Leased aircraft may or may not be fitted depending on where they are sourced and/or previously used. If the Virgin aircraft I mentioned above are on sold or leased they would be equipped but whether this would be used is another matter.

The final Fokker 70 is expected to leave KLM Cityhopper during 2018 (Airliner World March 2014 P7).
